What is SB 553 and who does it apply to?

SB 553 (California Labor Code Section 6401.9) is a law requiring virtually all California employers to maintain a written Workplace Violence Prevention Plan (WVPP), Violence Incident Log (VIL), and employee training program. It took effect July 1, 2024. Limited exemptions exist for certain healthcare facilities, fully remote workers, and workplaces with fewer than 10 employees not accessible to the public.

What are the penalties for not complying with SB 553?

Cal/OSHA can issue citations ranging from $18,000 to $25,000 for general and serious violations, up to $150,000 for willful or repeat violations, and $15,000 per day for failure to correct cited violations. Criminal penalties for willful violations causing death can include fines up to $250,000 and 6 months imprisonment.

What is the difference between a WVPP and an IIPP?

A WVPP (Workplace Violence Prevention Plan) is a standalone document required by SB 553 that specifically addresses workplace violence prevention with 12 required sections. An IIPP (Injury and Illness Prevention Program) is a separate document required under Labor Code Section 6401.7 covering general workplace hazards. Your IIPP does not satisfy the WVPP requirement.

Do small businesses need to comply with SB 553?

Most small businesses must comply. The only size-based exemption is for workplaces with fewer than 10 employees that are not accessible to the public. If customers, clients, patients, or any members of the public enter your workplace, you must comply regardless of business size.
